The terms governing material submitted to Potato Eater Productions.

Submission Release and Agreement

Effective Date: May 26, 2026

This Submission Release and Agreement (the “Agreement”) is entered into by and between Potato Eater Productions LLC, a Florida limited liability company (“Potato Eater Productions,” “we,” “us,” or “our”), and the person submitting material described below (“Submitter,” “you,” or “your”). By submitting any material to Potato Eater Productions — including scripts, screenplays, treatments, pitches, reels, audiovisual works, demos, or other creative material (collectively, the “Material”), whether by email, file transfer, postal mail, link, or any other means — you affirmatively acknowledge that you have read, understood, and agree to be bound by every term of this Agreement.

  1. Voluntary Submission. You are submitting the Material to Potato Eater Productions voluntarily, on an unsolicited basis, and without any prior request or inducement by Potato Eater Productions, except where Potato Eater Productions has specifically and in writing solicited a submission from you.
  2. Ownership and Originality. You represent and warrant that (a) you are the sole author and owner of the Material, or that you have obtained all rights, licenses, consents, and permissions necessary to submit the Material under this Agreement; (b) the Material is original to you and does not infringe upon or violate the rights of any third party, including without limitation rights of copyright, trademark, publicity, privacy, or contract; (c) you are not subject to any agreement, including any guild or union agreement, that limits or prohibits your right to submit the Material; and (d) the Material is not subject to any encumbrance, claim, lien, or option that would prevent Potato Eater Productions from evaluating or using it on the terms described in this Agreement.
  3. No Confidentiality; No Fiduciary Relationship. You acknowledge and agree that no fiduciary, confidential, implied-in-fact, implied-in-law, or other special relationship exists between you and Potato Eater Productions by virtue of your submission or its evaluation. Potato Eater Productions assumes no obligation of confidentiality with respect to the Material, and no obligation to use, develop, produce, distribute, return, acknowledge, or respond to the Material.
  4. Independent Creation; Access to Other Works. You acknowledge that Potato Eater Productions, its members, officers, employees, agents, affiliates, contractors, and other personnel (collectively, the “Potato Eater Parties”) are exposed to, develop, evaluate, acquire, produce, and have access to a great deal of original creative material from many sources, some of which may be similar or even identical to the Material in theme, idea, plot, character, format, structure, treatment, dialogue, or other elements. You acknowledge that such similarity or identity may arise from independent creation, public-domain sources, or coincidence, and you agree that the existence of such similarities, however close, shall not give rise to any claim, demand, suit, or right to compensation against any Potato Eater Party, except in the event that Potato Eater Productions executes a separately negotiated, written agreement with you concerning specific use of the Material.
  5. No Compensation; No Obligation. You acknowledge that Potato Eater Productions has not agreed to pay any compensation for the Material or for its evaluation, and that Potato Eater Productions is under no obligation to enter into any further discussions or agreements with you. Any compensation, credit, or other obligation owed to you in connection with the Material, if any, shall be determined exclusively by a subsequent written agreement signed by an authorized officer of Potato Eater Productions. Until such an agreement is fully executed, Potato Eater Productions has no rights in the Material and no obligation to you.
  6. Limited License to Evaluate. You grant Potato Eater Productions a non-exclusive, royalty-free, worldwide license to reproduce, view, store, evaluate, and internally circulate the Material solely for the purpose of evaluating whether Potato Eater Productions wishes to pursue further discussions concerning the Material. This license terminates upon notice from you that you wish it to terminate, except to the extent that Potato Eater Productions is required to retain a copy of the Material for legal, recordkeeping, or compliance purposes.
  7. Submitter Capacity. You represent and warrant that you are at least eighteen (18) years of age and have full legal capacity to enter into this Agreement.
  8. Release of Claims. You hereby release, waive, and discharge the Potato Eater Parties from any and all claims, demands, causes of action, damages, costs, or liabilities of any kind arising out of or related to (a) Potato Eater Productions’ receipt, evaluation, internal circulation, or non-use of the Material; (b) Potato Eater Productions’ subsequent independent development, acquisition, production, or release of works that may be similar to the Material in any respect; or (c) any other matter arising out of or related to the submission, except in the event that Potato Eater Productions executes a separately negotiated, written agreement with you concerning specific use of the Material.
  9. No Warranty of Use; No Return. Potato Eater Productions makes no warranty or commitment that it will read, evaluate, respond to, acknowledge, or return the Material. You should not submit the only copy of any Material. You agree that Potato Eater Productions has no obligation to return any Material submitted.
  10. Governing Law; Venue. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to this Agreement or the submission shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts and waive any objection to venue therein.
  11. Entire Agreement. This Agreement constitutes the entire agreement between you and Potato Eater Productions with respect to the submission and supersedes all prior or contemporaneous discussions, agreements, or understandings. No modification of this Agreement shall be binding unless in writing and signed by an authorized officer of Potato Eater Productions.
  12. Severability. If any provision of this Agreement is held to be unenforceable, the remaining provisions shall continue in full force and effect.
  13. Acceptance by Submission. By submitting Material to Potato Eater Productions, including by email, file transfer, postal mail, link, or any other means, you affirmatively acknowledge that you have read, understood, and agree to be bound by every term of this Submission Release and Agreement.
